On April 7, 2009, Ohio enacted House Bill 525 to promote more legible and reproducible documents being filed for record in the State. An additional $20.00 fee will be charged by the County Recorders for documents executed on or after July 1, 2009, which do not meet the following requirements:
- Print size not smaller than a computer font size of 10
- Paper size not less than 8½ X 11 inches and not more than 8½ X 14 inches
- Black or blue ink only
- No use of highlighting
- Margins of 1 inch width on each side and across the bottom of each page
- A 3 inch margin across the top of the first page and a 1½ inch margin across the top of each of the remaining pages
The Recorders will accept documents for recording even if they are not in compliance, but only upon payment of the additional $20.00 in recording fees.
Hence, mortgage lenders and servicers should review and revise forms for mortgages, assignments of mortgages, and releases, to be recorded in Ohio, to ensure compliance with the new law.
