A trend has emerged in many counties in Ohio, whereby the county engineer ‘s express approval of the property’s legal description is required before a foreclosure can be completed. Many counties may have reformatted the legal descriptions of their properties. Hence, as a separate matter from the processing of the foreclosure, a growing number of counties require the additional task of obtaining the approved legal description.
If a county requires this additional procedure, our firm will submit the required application to the county for approval, and will follow up with county officials in order to obtain the approval with minimal delay caused to the foreclosure case. This additional service, which is outside the scope of routine services provided in the foreclosure, WWR will require an additional $125.00 attorney’s fee.
In some counties, a new survey may be required before the county will issue an approved legal description. In the event a county requires a new survey or imposes any additional requirements, we will advise you as to the anticipated cost and any additional fees.
