As of March 16, 2009, Sheriff Warren Evans of Wayne County, Michigan discontinued his requirement for the TARP-related affidavits effective immediately. As stated in our previous client advisories on February 3, 2009 and February 25, 2009, Sheriff Evans instituted an affidavit system requiring lenders to disclose their acceptance of TARP funds and mitigation efforts prior to proceeding to foreclosure. The Sheriff has now discontinued any such requirements and is proceeding to complete foreclosures pursuant to Michigan law.
